Macedonian Journalist Arrested. Attorneys Without Borders Urges Serbian Authorities to Protect his Human Rights.

19/02/14

Zoran Bozinovski is a journalist from Macedonia and the owner of the popular Serbian based website Burevesnik.

In November 2013 he was detained and imprisoned in Serbia after Macedonian authorities issued an Interpol arrest warrant.

Mr Bozinovski has been charged with foreign espionage, criminal conspiracy and blackmail under the oppressive and unchallengeable criminal code of Macedonia. He is being held in a Serbian jail until the Macedonian government officially files for extradition.

He’s also been accused of working for a foreign government as an active member of a spy ring. His detention has attracted widespread criticism from both national and international organisations pledged to protect human rights and highlight abuses of personal freedom.

A member of his family told us: “I am certain about Zoran’s innocence. He is a good man and has been wrongfully charged.”

He has noted that all the information he has, he publishes on his website –therefore he is not a spy. In the past Mr Bozinovski has been known to threaten and publish confidential content on his popular site. Controversial articles he has published allege foul play, corruption and sinister repression within both the Macedonian government and organized crime syndicates. He claims both are inextricably linked.

Burevesnik is most widely read by tens of thousands of Macedonians and those across the Balkan Peninsula each day. Macedonians trust the veracity of his information, the content of his articles and the reliability of his sources, particularly involving claims of insidious corruption. In the past his stories have led to him being physically attacked and seriously injured. He felt forced to leave Macedonia with his family but has pursued his role as a committed journalist in Serbia.

There have been a number of claims stating that his detainment is wholly unwarranted. Many suggest his detainment is solely a result of his previous publications, which are undoubtedly controversial.

Macedonia was ranked 116th of out 179 countries according to the media charity Reporters Without Borders 2013 press freedom index. This deplorable rating is due to the country’s repressive and restrictive legislation and the government’s hostility towards any critical press.

It fact Macedonia dropped 22 places since 2011-12 following the arbitrary withdrawal of media licences and deterioration in the environment for journalists. It would be a fair assumption to make that if Mr Bozinovski was returned to Macedonia the likelihood of him receiving a fair trial is arguably negligible.

Attorneys Without Borders believe that innocent people should not be unlawfully detained. We urge the Serbian authorities to uphold his human rights – innocent until proven guilty, the right to a fair trial, the right to free speech and freedom of expression. These are fundamental human rights enshrined in a number of conventions, instruments and treaties. Most importantly, freedom of opinion is protected by

Article 19 of the Universal Declaration of Human Rights. Article 19 states “Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.”

The UNS (Journalists’ Association of Serbia) has warned Serbian’s Ministry of Justice that, by complying with the extradition request, Zoran Bozinovski’s liberty will depend on a regime proven to be indifferent to a fair and open legal system; a regime that actively denies human rights; a regime that bulldozes through suspect convictions based on flawed evidence and an unaccountable judiciary.

The UNS has urged the Serbian authorities to safeguard and champion a journalist’s inalienable right to pursue their profession unhindered by an authoritarian state. Zoran Borinovski’s extradition will result in a number of human rights breaches.

Attorneys Without Borders believes that Serbian authorities must protect his fundamental human rights and recognise the importance of his role in the Macedonia media. Please help share his story and protect his human rights.
